REGULATORY RESOLUTION NO. 2007-1
PARKING REGULATIONS
Effective Date: September 18, 2007
WHEREAS, Article II, Section l(e) of the Declaration of Covenants, Conditions and Restrictions (hereinafter "Declaration") and Article VII, Section l(a) of the Bylaws of the Cloisters West Homeowners Association, Inc. (hereinafter the "Association') authorize the Board of Directors to adopt, amend and publish rules and regulations governing the use of common property and the conduct of the Association members and their guests thereon; and
WHEREAS, Article VI, Section 21 of the Declaration charges all Lot owners and their tenants, guests and invitees with compliance with the Declaration, Bylaws, Rules and Regulations (the 'Governing Documents) of the Association as amended;
NOW, THEREFORE, IT IS HEREBY RESOLVED THAT the Board of Directors by this Act, the Governing Documents and this resolution are hereby empowered to adopt, amend and publish rules and regulations regarding the parking of vehicles on the common property of Cloisters West Homeowners Association, Inc. and pursuant to said authority adopt the following rules regarding parking:
This Resolution applies to all residents and guests of Cloisters West residents and to all alleyways and common areas open to vehicle traffic within the boundaries of Cloister West. Homeowners are required to advise their tenants of these parking regulations if their property is leased. Because of the limited parking in Cloisters West, homeowners and/or tenants should encourage their guests to carpool, use taxicabs or public transportation or use street parking in the adjoining area (Reservoir Road, 35th, 36th and 37th Streets).
A. The Cloisters contains two homeowners associations: Cloisters West Homeowners Association, Inc. (Cloisters West) and Cloisters of Georgetown, Inc. (Cloisters East). The common areas open to vehicle traffic within the geographic areas of both associations are confined to Winfield Lane and the adjoining alleyways. Signs throughout the community designate no parking areas because of fire lanes or other reasons.
B. Winfield Lane consists of three lanes:
1) An east/west lane with an entrance from 35th Street, N.W. Homes facing this lane have even numbered addresses 3502-3672 Winfield.
2) A north/ south lane with an entrance at 37th Street and Reservoir Road, N.W. Homes on this '37th Street Extension" have odd numbered addresses: 3701-3749 Winfield.
3) A north/ south lane with a limited access entrance at 36th Street and Reservoir Road, N.W. Homes on this '36th Street Extension" have odd numbered addresses: 3601-3639 Winfield.
II. COMMUNITY PARKING PLAN
Each home in Cloisters West has been designed with two parking spaces – one space in the home's driveway and one space in the home's garage. As a result, the developer created the community with only limited excess parking spaces. These excess parking spaces are intended solely for the use of guests and not as a "third" parking space for any resident.
III. III. PARKING PERMITS/MEDALLIONS
A. Parking on the common property by residents and guests is by permit (hereinafter "medallion") only. Service personnel vehicles should be instructed to park in your driveway or pad or must display a medallion when they are parked on common areas. When using a medallion to park in common areas, service vehicles must park in permit parking designated locations only.
B. One plastic medallion shall be issued to the owner of each Cloisters West home and may be reissued periodically by the Board of Directors and the Property Management Company. Each medallion shall be inscribed with the address of the residence. The medallion is to be displayed in clear view, hanging from the rear view mirror. The medallion shall be the only valid parking identification in Cloisters West.
C. A lost medallion shall be replaced by purchase from the Property Manager and shall be marked as a Replacement, thereby voiding the prior medallion. The initial replacement fee shall be $100; the second replacement fee shall be $200; the third replacement fee shall be $400. The Property Manager shall have no authority to issue a fourth replacement parking medallion. A request for a fourth replacement must be submitted as a written appeal to the Board of Directors. Requests for first, second or third replacement medallions must be in writing to the Property Manager.
A. There are sixteen spaces available for parking with a medallion:
1) On the east/west lane of Winfield - 10 spaces between:

2) On the north/ south 37th Street Extension - 3 spaces between:
3723-3725 Winfield

3) On the north/ south 36th Street Extension - 3 spaces: in front of 3603, 3605, and near 3609 Winfield. The entrance to house's sidewalks must not be blocked.
B. All alleyways in the community are designated as No Parking areas for Fire Lane purposes.
A. Vehicles may extend from private driveways into the east/west Winfield Lane for safety purposes only (i.e. steep driveway, snow or ice conditions). The extension of the vehicle must not impair or impede traffic on Winfield Lane at any time.
B. With the exception of snow or icy conditions, and then only on the east-west lane of Winfield Lane, vehicles shall not be parked across entrances to or across from driveways or parking pads. In the event of these exceptions, if a vehicle is so parked, it must in no way interfere with any other driveway.
Cars parked in violation of this Resolution shall be subject to one or more of the following:
• Ticketing by the Metropolitan Police or District of Columbia Traffic Enforcement personnel
• Fining by the Association's Board of Directors and/or Covenant Committee Members
• Towing at the owner's expense. The Association shall not be liable for towing, storage fees, or for any damage to a towed vehicle.
• Loss of common area on-street parking privileges by medallion revocation for a period of up to one year when, in the judgment of the Board of Directors, continued violations are associated with the particular home or residents.
Residents are encouraged to call the Metropolitan Police to report parking violations, especially those that involve parking in the fire lanes. (Call 311 to report parking violations.) Reports may also be given to the Property Manager. Examples of parking violations include, but are not limited to, the following:
A. Time Limits: No vehicle shall be continuously parked in any one place on Winfield Lane for more than 72 hours or more than 3 consecutive nights.
B. Parking Signs: Parking signs throughout the community indicate the areas were parking is prohibited. Parking in violation of any posted sign is prohibited.
C. Counterfeit Medallions: Use of counterfeit, expired, invalidated, revoked or any unauthorized Association parking medallion is strictly prohibited.
Violators are subject to ticketing by the Metropolitan Police or District of Columbia Parking Enforcement personnel and the Board or its committees. Except for Fire Lane violations any violation of the provisions of this Resolution shall result in a $100 fine by the Association per incident and an additional $100 fine per day for each 24-hour period the violation remains uncorrected. Parking in Fire Lanes shall result in a $100 fine by the Association in addition to any ticket issued by the Metropolitan Police or District of Columbia Traffic Enforcement personnel.
Fines charged to a homeowner's account are due and payable within 15 calendar days of issuance. To avoid additional monetary penalties, the homeowner must take one of the following actions:
1) Pay the fine. If the homeowner admits liability and waives the right to a hearing, the homeowner must mail a check payable to the Cloisters West Homeowner's Association, to the Property Manager, or
2) Request a hearing with the Board of Directors. If the homeowner wishes to contest the fine, a hearing must be requested in writing submitted to the Property Manager within 15 calendar days of the date of the fine. A hearing date will be set and the provisions of Regulatory Resolution No. 2003-1, Enforcement Procedure Sections I(D) through Section IV, will generally apply.
Failure to remit payment or to request a hearing in accordance with this Section VII within 15 calendar days, or to attend the scheduled hearing shall constitute an admission of liability and shall result in the automatic doubling of each fine.
This Resolution, which amends Resolution No. 2006-1, was passed by the Board of Directors at its September 18, 2007 meeting, at which a quorum was present, and became effective immediately.
